Starting May 2029, most new electric storage water heaters will effectively need to be heat pump models. Here's what the rule actually requires, what it doesn't touch, and what it costs.
DOE's final rule on residential water heaters, issued in 2024, sets new minimum efficiency standards that take effect for units manufactured on or after May 6, 2029. It's adjacent to HVAC rather than part of it, but it comes from the same regulatory logic as the furnace rule, and it's about to change a very common replacement decision.
The key detail: for the most common electric storage water heater sizes (above 35 gallons), the new efficiency level is high enough that only heat pump water heater technology can realistically meet it. It isn't written as an outright ban on electric resistance tanks — DOE's own framing is an efficiency standard, not a technology mandate — but the practical effect is close to one for that size class: DOE's own estimate is that compliant heat pump models will jump from about 3% of new electric storage water heaters sold today to over 50% once the rule is in force.
Gas-fired and oil-fired storage water heaters get more modest efficiency bumps under the same rule, not a heat-pump mandate. And DOE has kept gas instantaneous (tankless) water heaters out of this rule while it considers separate standards for that category. If you're set on staying with gas, this rule isn't the thing pushing you toward electric.
A heat pump water heater costs meaningfully more upfront than a standard electric resistance tank, and it has real installation differences that matter in practice: it needs more surrounding air volume to pull heat from (a cramped closet installation often isn't a straight swap), it produces some cool, dehumidified exhaust air near the unit, and it's a taller, more complex piece of equipment than a simple electric tank. DOE's own projected payoff is an average of roughly $1,800 in utility bill savings over the appliance's life for someone switching from resistance to heat pump — but that's a lifetime number, not a first-year one, and the upfront cost gap is the part homeowners actually feel at replacement time.
If your electric water heater is getting old, the practical planning question isn't "should I panic-replace it today" — it's whether, when it does eventually need replacing, you (or your contractor) will be shopping in a market where resistance-tank options in your size class are getting harder to find and heat pump units are the default. Knowing that now is useful mainly so the cost and space requirements aren't a surprise when the day comes.
